TERMS AND CONDITIONS - GENERAL

A. and F. Border Plus Ltd. General Terms and Conditions (07.14)
These terms and conditions govern the contractual relationship between A. and F. Border Plus Ltd – referred to as BorderPlus, and each individual or group of people – referred to as the ‘client’ or ‘participant’ ‐ who confirm a booking to make use of services provided by A. and F. BorderPlus Ltd.


By booking your arrangement with us, you are agreeing to be bound by the terms of this Agreement. You agree on behalf of yourself and those you represent to comply with all such terms and conditions, including the payment of all amounts when due. You agree that any violation of any such terms and conditions may result in (a) the cancellation of your reservation or purchase, (b) your forfeiture of any money paid for your reservation or purchase, (c) you being denied access to the applicable related product or service, and (d) our right to debit your account for any costs we incur as a result of such violation.


Application and Enrolment Process
 

  1. Application:

Step 1: Request for a Quote “Get a Quote” or email us your request . Please make sure that the information you send us is accurate and complete
 

Step 2: Check the "Terms and Conditions" box in our “Get a Quote
 

Step 3: BorderPlus, upon request from your part, shall provide any assistance you require for the booking of your accommodation. A “preferred hotels list” can be found in our website, but you are free to choose any other place for your accommodation which, upon your request, we may contact and make a booking.
 

Step 4: BorderPlus gets back to you with a quote.
 

Step 5: Review your quote and confirm or email additional clarifications/requests. The final quote will be valid for a period of seven (7) days.
 

Step 6: Final confirmation provided by BorderPlus and issue of invoice.
 

Step 7:

  • (a) Take your pre-arrival English test.
  • (b) Proceed with your payment via Paypal or international bank transfer in full,  within 15 working days from confirmation and no less than 20 working days before the course starts.  Special arrangements may be made for last minute bookings.
  • (c) Proceed with your visa application, if applicable.
  • (d) Proceed with your travel arrangements (e.g. flight details, arrival dates, etc).
     

Step 8: BorderPlus will book your place on the course and send further details to you by e-mail.
Your privacy is important to us. Please note that by submitting your personal data to us, you are accepting the terms described in our Privacy Policy.

 

  1. Payment deadline:

Payments
Clients are to make payments in advance by ONLINE payment (PAYPAL) or international bank transfer and are to be received by BorderPlus in full within 15 working days from confirmation. If a booking is made less than 20 working days before the course starts, the fees are immediately payable. If payment in full has not been received, you will not be allowed to start your course. Special arrangements may be made for last minute bookings. Payment information and bank details are provided on the booking invoice. When transferring payment, the Client agrees to pay all international bank transfer costs.


Additional lessons, activities and services booked after participant has arrived in Cyprus, must be paid for in full before the service commences.

 

  1. Travelling to Cyprus (Travel Documents, Visa information, etc):

It is your responsibility to arrange your travel details and ensure that all of the details on your travel documents are correct.  BorderPlus will not be held responsible for your travel arrangements to Cyprus and decisions taken by authorities regarding entry visas or visa extensions.

  1. Pre-arrival test:

Right after completing and sending us your “Get a Quote and Book your Course” form, you will receive your “Pre-Arrival English Test”, which you will have to complete and send back to us. Please note that the test does not determine whether you can or cannot attend a course.  It is merely an indicator of your overall English level, which will be taken into account for placement and course preparation purposes only.

 

  1. Accommodation:

BorderPlus, upon request from your part, shall provide any assistance you require for the booking of your accommodation. A “preferred hotels list” can be found in our website, but you are free to choose any other place for your accommodation which, upon your request, we may contact and make a booking. BorderPlus covers the transportation expenses from/to course venue and scheduled activities provided that participants choose among “preferred hotels list”.  The booking shall be in your name. BorderPlus shall not be held liable for any loss or damage you may suffer in this respect.  It is the responsibility of the participant to pay for any accommodation extensions.  

 

  1. Travel and medical insurance:

Travel and Medical insirance is compulsory at all BorderPlus courses for the duration of your stay regardless of your course length or course/visa type.  You will be required to show proof of medical and travel insurance prior to your arrival. You will not be allowed to commence a course until you have obtained satisfactory medical and travel insurance.


If you don't have a medical and travel insurance and would like us to furnish you with one, kindly let us know and we will arrange for an Insurance Company to contact you asap.

 

  1. Health declaration:

Participants must report any mental or physical illness, allergy, disability or condition that may interfere with their ability to successfully complete their programme, that may impact the health and well-being of any other participant, host or staff member, that may require monitoring, treatment or emergency intervention of any kind during the participant’s anticipated period of enrolment, or that may require special accommodations.  BorderPlus reserves the right to reject an applicant or terminate a participant’s particopation in the programme, if the participant’s continued attendance represents a risk to their health and safety or to the health and safety of other participants or staff, or if, notwithstanding reasonable accommodations, in the opinion of BorderPlus, the participant’s physical or mental condition makes the participant unable or unlikely to successfully complete their programme. Refunds in such circumstances are at the discretion of BorderPlus.

 

  1. Tuition fees:

Tuition fees include lessons, pre-arrival test, complimentary excursion, coffee breaks and a BorderPlus certificate upon completion of the course. Any additional services are not included in the tuition fees unless specifically stated on a valid invoice.

 

  1. Flight details:  

BorderPlus will not be held responsible for any changes regarding your flight details.  We accept no liability for costs which may arise as a result of such changes.

 

  1. Airport Transfers:
  • If the participant requests from BorderPlus to coordinate your airport transfers , flight details must be sent to BorderPlus at least one week prior to arrival (unless you are booking late in which case you are to contact us directly as soon as possible). BorderPlus will not be held responsible if this information is not accurately relayed.
  • Taxi firms contracted by BorderPlus reserve the right to charge additional waiting times exceeding 1 hour.

 

  1. Under 18 year olds: BorderPlus delivers adult courses (except for programmes advertised as being for young learners).

 

Course Participation - Terms and Conditions

  1. Rules and regulations: Participants’ arrangements with BorderPlus are governed by the laws of the Republic of Cyprus. On confirmation of booking (via Web, e‐mail phone or mail) both A&F BorderPlus Ltd. and the participant (s) bind themselves to these terms and conditions.
  1. Venues

Courses are offered in seminar rooms at one of the” preferred hotels list”, or in Conference rooms located just a few minutes away from the “preferred hotels list”.  BorderPlus reserves the right to use conference rooms and/or seminar rooms and/or classrooms in premises of a similar standard.
 

  1. Arrivals and departures:
  • Accommodation may be booked according to your flight details and the duration of your course eg from the Sunday before the course start date until the Friday after the course end date, unless otherwise advised or scheduled.
  • Airport transportation may be booked according to your flight details. 
  • BorderPlus will not be held responsible for any changes regarding your flight details.  We accept no liability for costs which may arise as a result of flight details.
     
  1. Late arrivals, vacations and absences: If you begin your participation late or are absent during your course, no refund will be made for the time missed. We will do our best to help  but we cannot guarantee that we can make up for hours you missed.
     
  1. Meals, classes and activities missed: No refunds or substitutions will be made for meals, lessons and activities missed due to any reason and obligation that falls outside the normal schedule.
  1. Duration of lessons: Courses include 20 lessons, 45 minutes each, unless otherwise stated (e.g. tailor-made courses, etc). Courses run from Monday to Friday, unless otherwise stated.  Lessons are mainly scheduled in the morning.  During the course, BorderPlus reserves the right to modify the lessons schedule at short notice.

 

  1. Level of English: If a participant is found to be at a level which is not appropriate for their booked course they may be advised to follow a tailor-made syllabus that will cater for their needs.

 

  1. Insufficient demand: Standard courses run with a minimum of 3 people per group. If there is insufficient demand for a specific course start date, BorderPlus reserves the right to treat this course as a private course and modify its number of lessons e.g. offer fifteen instead of 20 lessons), without affecting nor compromising in any way the syllabus, the content or the goals and objectives of the course. If such a case occurs, all affected participants will be notified accordingly.
     
  1. Coordination of courses:  BorderPlus is collaborating with experienced teachers and trainers who design course syllabi based on BorderPlus participants’ needs. 
     
  1. Books and learning materials: All books and learning materials will be made available to participants during their course. A book deposit (EURO 40) may be charged at the beginning of the course. This will be refunded at the end of the course, provided that the books are returned in good condition. Some courses may require the purchase of books.

 

  1. Expulsion/Suspension: Any participant who commits a criminal offence, exhibits unacceptable, unruly or disruptive behaviour, has, in BorderPlus’ opinion, a poor attendance record (whether or not such attendance is in breach of any visa attendance requirements), is absent, or fails to pay an amount he or she is directly or indirectly liable to pay BorderPlus in order to undertake the course, may be expelled or suspended. No refund will be given and the immigration authorities will be informed.


Participant Code of Conduct: As part of BorderPlus’s commitment to our participants’ success, we seek to provide an optimal learning environment and expect participants to conduct themselves in a manner that is considerate of those around them. Inappropriate conduct includes but is not limited to: 1) disruptions to the learning environment (i.e. use of profanity, harassment, mobile phone use in classrooms, etc); (2) deliberate destruction, misuse, or theft of BorderPlus property or the property of fellow classmates and BorderPlus partners ; (3) violence or threats of violence towards persons or property of participants or BorderPlus staff; (4) improper use of email or Internet access; and (5) failure to comply with local copyright or criminal laws forbidding the misappropriation, copying or alteration of copyright-protected materials.

 

  1. Loss of Property Insurance: BorderPlus will not be held responsible for loss or theft of any property belonging to any of its participants while on the course or accommodation venue, or on any other location.
     
  1. Liability:
  • (a) Α & F Border Plus Limited is a registered company (331932) in the Department of Registrar of Companies and Official Receiver of the Republic of Cyprus.
  • (b) The liability of A&B BorderPlus LtD, will be limited in all circumstances to the full amount paid to BorderPlus by the relevant participant for the particular course.
  • (c) A&F BorderPlus Ltd is acting as intermediary for products and services that are not directly supplied by us (e.g. courses, hotel accommodations, meals, tours, transportation, activities, etc.). We are not a co-vendor of such products and services. The participant will be entering into a separate contracts with such Suppliers or Service Providers in connection with such products and services.
  • (d) Accommodation, transportation and Activities ("the Services") available for booking are provided by local operators or other third parties that are entirely independent of A&F BorderPlus Limited and do not form any part of the product or services sold to the participant by A&F BorderPlus Limited or of these Terms & Conditions, even where A&F BorderPlus Limited suggests particular operators/other third parties and/or assists you in booking such services. Your contract for such Services will be with the organizer or operator of that Service and will be subject to its Terms & Conditions. A&F BorderPlus Limited has no liability for any such optional activity or excursion or for any act(s) or omission(s) of the organizer or operator or for any of its employees or agents or any other person(s) connected with the optional activity or excursion. Any advice or assistance on or with any Service provided by any local representative does not mean or imply that the Service is sold, supervised, or controlled by A&F BorderPlus Limited or that any such advice or assistance is given on behalf of A&F BorderPlus Limited.
     

Your contract with your Suppliers may allow them to cancel or amend bookings. We will ensure that the participant is promptly notified of any significant changes once we become aware of such change, if there is time before your departure, but we accept no liability for any changes or costs incurred that may result. Subject to the Supplier’s terms and conditions, the participant will then have the choice of accepting the change of arrangements, accepting an offer of alternative arrangements if one is made available by the Supplier, or canceling your booked arrangements and receiving any applicable refunds. We do not guaranty that any refunds will apply.
 

  • (e) Damage to Property:  Clients must pay the full cost of any damage they cause to school property or property belonging to companies or individuals contracted by BorderPlus.

 

  1. Force majeure: If the services included in the course cannot be supplied or there are changes for reasons beyond the control of BorderPlus, depending on the circumstance, BorderPlus may take reasonable action to arrange for the provision of comparable services. BorderPlus will not be liable in cases where BorderPlus is unable to fulfill any services to which they are contractually bound because of fire, natural disaster, act of government, failure of suppliers or subcontractors, labour disputes or other reasons which are beyond BorderPlus’ control.

 

  1. Photography, Filming and Sound Recording: BorderPlus or its representatives may arrange to photograph or shoot video footage of participants for promotional purposes, both printed and online. Any participant who does not wish to participate should advise us at the time of booking and state at the time of the photographing or video shooting their wish not to participate.  By accepting these terms and conditions, the participant gives consent to the use of these photographs or video footage without further consent or notifications.

 

  1. Visa: Participants who receive a visa but fail to show up for their course will be reported to the Civil Registry and Migration Department of the Republic of Cyprus. Information collected by BorderPlus which personally identifies a participant and information regarding a participant’s course progress may be shared with the designated government authorities and BorderPlus staff. This information may include personal and contact details, course enrolment details and changes, and circumstances of any suspected breach by the participant of any visa condition.  

 

REFUND POLICY

Refunds will be made to the participant’s bank account in the same country in which the fees were originally paid. All refunds will be made after receiving  written notification. In the event of BorderPlus cancelling or terminating a course, a full refund of all unused fees will be made. No refund requests will be processed, if received two weeks after the commencement of the course.

 

CANCELLATION/POSTPONEMENT POLICY
 

Cancellation, amendments and Fees

  • ‘Cancellation’ means cancelling a course before the start date of the first course lesson the participant is attending.  Clients may cancel their booking any time prior to the commencement of the course.
  • All cancellation notifications must be provided in writing.
  • If BorderPlus is forced to cancel a programme, BorderPlus will either provide a suitable alternative or refund payment in full (minus bank charges).
  • BorderPlus reserves the right to charge an administration fee each time the course, start date, accommodation, etc is changed or postponed by the participant after BorderPlus has confirmed the initial enrolment. This also includes requests for changes whilst the participant is attending the course and for reissuing certificates.
  • Course Cancellation Fees
  • For cancellations made more than 22 or more days before the start of the course, any fees paid over and above the deposit will be refunded.
  • If you cancel your place on a course 21 or less days prior to the start date, you will not be entitled to a refund, except in exceptional circumstances, at the discretion of BorderPlus. In circumstance that a refund is given, an administration fee may be levied.
  • Bookings may not be cancelled after the scheduled arrival and no refunds will be provided. No refunds will be made to participants who fail to show up.
  • For cancellations and postponements made less than 7 days before the arrival date listed on the booking confirmation form, fees will not be refunded.  In all cases where a visa or visa support documentation has been issued, the relevant immigration authorities will be informed. In the event of a postponement, you may be re-booked at the rates currently in effect at the time of re-booking.
  • For hotels, apartments and any other third party providers, reservations’ cancellation fees are determined by the terms and condition of each service provider, which may amount to the full stay charge.
  • Visa participants: Once a visa is issued, no refunds or course cancellations are permissible other than in the instance of visa refusal and subject to meeting the following criteria: the amounts paid will be refunded, less an administration charge (plus any courier and transfer charges) on production of the following documents at least 21 days before the arrival date: (1) a certified copy of the visa refusal letter, (2) a certified copy of the participant’s passport showing both a photograph and signature; (3) where the payor was not the participant, an original authority letter from the participant authorising the repayment to the payor and (4) where the participant is already in Cyprus, evidence satisfactory to BorderPlus that the participant has left Cyprus. Refunds will only be made under this paragraph if requested in writing with the necessary supporting documents within four weeks after the commencement of the course (published date). In circumstances where an application is refused by the competent authorities of the Republic of Cyprus on the grounds of fraudulent documentation or other irregularities, no refunds will be granted in respect of money paid.

 

TERMINATION POLICY

‘Termination’ means stopping or leaving all or part of the course or courses booked, including extensions, once the first course has started.  In all cases additional service charges (eg. airport transfers, courier fees, enrolment fees, medical insurance, accommodation, placement fee, programme supplement fee, etc.) are non-refundable and written notification of termination must be given to BorderPlus. Participants who terminate their programme may not be eligible to receive a BorderPlus certificate.

 

Tuition

  • No refunds will be made for tuition. Tuition fees are non-transferable to other participants.
  • In all cases where a visa holder terminates his or her studies, the relevant immigration authorities will be informed.


Accommodation

Accommodation: Cancellation fees are determined by the terms and condition of each service provider, which may amount to the full stay charge.  
 

GENERAL

You represent and warrant that (a) you are of sufficient age to use our services and website and can create binding legal obligations in connection with your use, (b) you are legally authorized to act on behalf of those you represent and accept these terms and conditions on their behalf, and (c) the information supplied by you or members of your group is true and correct. You are responsible for informing such other persons of all terms and conditions applicable to their travel and course arrangements. You understand that you are financially responsible for any use of our services or website by you and those using your name or account.

CHANGES TO THIS WEBSITE

We may make improvements or changes to the information, services, products and other materials on this website, or terminate this website, at any time without notice. We may also modify these Terms and Conditions at any time, and such modification shall be effective immediately upon posting of the modified Terms and Conditions on this website.  Accordingly, your continued access or use of this website is deemed to be your acceptance of the modified Terms and Conditions.

BorderPlus makes no warranty whatsoever for the reliability, stability or any virus-free nature of any software being downloaded from this website, nor for the availability of the download sites where applicable.
 

All software products downloaded from any section of this website or via a link pointed to by this website are downloaded, installed, and used totally and entirely at the users own risk.
 

Your use of this website, any downloaded material from it and the operation of these Terms and Conditions shall be governed by, construed and interpreted in accordance with the laws of Cyprus and you agree to submit to the non-exclusive jurisdiction of the Cypriot Courts. We reserve the right to bring proceedings in the Courts of the country of your residence.
